i. These Terms & Conditions apply to services provided by T.J Dolphins Swim School trading as T.J Dolphins Swim School Ltd (“we”, “us”, “our”).

Acceptance of terms and statutory rights

i. By booking lessons and/or setting up a Direct Debit, you agree to these Terms & Conditions.

ii. Nothing in these terms affects your statutory rights as a consumer.

 

Definitions

i. Member: the adult (18+) who makes the booking and is responsible for payments and communications.

ii. Swimmer: the named child or adult attending lessons.

iii. Lesson: a scheduled session (typically 30 minutes).

iv. Monthly Block: all lessons scheduled for a swimmer within a calendar month.

v. Venue: the pool/site where lessons take place (which we hire and do not own).

 

Who is responsible for the booking

i. Your booking is with T.J Dolphins Swim School ltd.

ii. The Member is responsible for ensuring the swimmer (and any accompanying adult) complies with these terms, our safety instructions, and the venue’s rules.

iii. Bookings are for the named swimmer only and are not transferable to another person without our written agreement.

 

Rolling monthly membership 

i. We operate a rolling monthly membership.

ii. Your swimmer’s class place is reserved each month and continues until you cancel in line with the cancellation rules below.

iii. Because places are limited and staffing/venue costs are committed in advance, we operate a strict missed-lesson policy.

 

Lessons and venues

i. Lessons are typically 30 minutes long.

ii. Lessons take place at venues we hire.

iii. Because we do not own venues, lessons may occasionally be cancelled or disrupted due to venue closures/restrictions beyond our control (for example, maintenance issues, emergency works, school closure, or venue operational decisions).

iv. We will aim to notify you as soon as reasonably possible.

 

Pricing and variable monthly fees

i. Your monthly membership fee may vary because different months contain different numbers of lesson dates.

ii. The monthly fee is calculated based on the number of lessons scheduled for your swimmer in that calendar month.

iii. Pricing is generally consistent, but some venues may differ due to venue costs and operating constraints.

iv. The price that applies to you is the price confirmed at sign-up and shown in our communications.

v. Any price change will be communicated in advance and will apply to future months only.

 

Sibling discount

i. Where three siblings are booked and actively paying membership, a 10% discount is applied to the total cost.

ii. If the number of sibling memberships falls below three, the discount will stop from the next applicable billing cycle.

Payments by Direct Debit and collection date

i. Membership is paid by Direct Debit.

ii. Payments are collected on or around the 25th of each month.

iii. If the 25th falls on a weekend or non-banking day, we collect payment on the working day immediately before.

iv. Because the monthly amount can vary, you will be notified of the amount to be collected and the lesson dates it covers.

 

Advance notice of variable Direct Debit amounts

i. We usually provide notice automatically around five days before collection.

ii. By signing up, you agree that this notice period is acceptable for your membership.

iii. You remain protected by the Direct Debit Guarantee through your bank.

 

New starters and alignment payment

i. New starters may be required to make a one-off alignment payment so that ongoing payments align with our monthly Direct Debit schedule.

ii. This payment covers lessons between the swimmer’s start date and the first regular monthly collection date (or brings the account into the standard billing rhythm).

iii. We will explain the amount and what it covers before taking payment.

 

Missed lessons

i. We do not offer catch-up lessons, swaps, or make-up sessions for missed attendance.

ii. If the swimmer does not attend a lesson for any reason (including illness, holidays, travel, birthdays, or other commitments), that lesson is forfeited and remains payable.

iii. This is because the class space is reserved and our staffing and venue costs remain.

 

Cancelling membership (30 days’ notice)

i. You may cancel membership by giving at least 30 days’ notice in writing by emailing t.j.dolphins@outlook.com.

ii. Notice is counted from the day we receive your email.

iii. If we receive your cancellation with at least 30 days before your next scheduled collection date, your membership will end at the end of the current paid period and no further Monthly Block will be collected.

iv. If we receive your cancellation with fewer than 30 days before your next scheduled collection date, one further Monthly Block may still be collected and the cancellation will apply from the following billing cycle.

v. We do not provide cash refunds for unused lessons within a paid month, except where required by law.

 

Pausing or freezing membership

i. We do not offer membership freezes or pauses as standard.

ii. Any exception is at our discretion and must be agreed and confirmed in writing.

 

If we cancel lessons or a venue closes

i. If we cancel a lesson for any reason, including venue closure or teacher absence, our standard remedy is a lesson credit for the cancelled lesson.

ii. Credits are applied to the swimmer’s account and reduce future charges by the value of the credited lesson(s) when you next pay.

iii. Credits are provided as lesson credits (one credit per cancelled lesson), are for the named swimmer only, and are not exchangeable for cash.

iv. We do not offer cash refunds as standard; however, nothing in these terms removes any legal right you may have to a refund where one is required under consumer law.

 

Class sizes and operational flexibility

i. We reserve the right to adjust class sizes, staffing arrangements, and class structures where we reasonably consider it necessary for safety, swimmer development, staffing, or operational reasons.

ii. This includes the right to merge classes or amend groupings.

iii. Instructors may change from time to time.

 

Parents on site, parent & toddler rules, arrival, and collection

i. For children’s lessons where the parent/guardian is not in the water, a parent/guardian must remain on site for the full duration of the lesson and be contactable.

ii. Parents/guardians remain responsible for their child before the lesson begins and after the lesson ends, including in changing areas and other non-pool spaces.

iii. For parent & toddler lessons, the accompanying adult must be in the water for the duration of the session, must remain responsible for the child at all times, and must follow the teacher’s instructions.

iv. Parent & toddler lessons are for children aged two years and over unless we confirm otherwise in writing.

v. The ratio is one adult per child.

vi. Please arrive with enough time to be ready for your start time. If you arrive late, we may not be able to admit the swimmer if doing so would disrupt safety, teaching, or the venue timetable. Lessons still end at the normal scheduled time.

vii. We do not operate a fixed late-collection fee. Timely collection is a safeguarding requirement. If a child is not collected promptly, we will attempt to contact the parent/guardian and emergency contacts. Persistent late collection or failure to collect may result in suspension or termination of membership.

 

Health, illness, and exclusion

i. Swimmers and accompanying adults must not attend if they have vomiting or diarrhoea, or have had vomiting/diarrhoea within the previous 48 hours.

ii. If a swimmer is diagnosed with cryptosporidiosis, they must not attend swimming until 14 days after the last diarrhoeal episode.

iii. If we reasonably believe someone is unwell in a way that could risk others or the venue, we may refuse entry.

iv. If entry is refused due to illness/exclusion concerns, the missed lesson is treated as a customer absence under the missed-lesson policy.

 

Swimwear and appropriate standards

i. Swimmers must wear appropriate swimwear suitable for a public pool environment.

ii. For safety and hygiene, we may require long hair to be tied back.

iii. We may ask that jewellery be removed if it could snag or scratch.

iv. We may refuse items that we reasonably consider unsafe or inappropriate in a children’s environment.

v. All customers must follow venue-specific poolside rules.

 

Behaviour and respect

i. We expect respectful behaviour at all times.

ii. Abusive, aggressive, discriminatory, harassing, or threatening behaviour towards our staff, venue staff, or other customers may result in removal from the site and may lead to immediate termination of membership.

 

Safeguarding and photography/filming

i. Photography and filming are not permitted at our lessons or within our lesson areas.

ii. This is a total ban and applies to phones, cameras, and wearable devices.

iii. Any breach may result in removal from site and termination of membership.

 

Lost property

i. Lost property is retained for one term and then donated or disposed of.

ii. We are not responsible for loss or damage to personal items brought to the venue.

 

Complaints

i. If you have a complaint, please email t.j.dolphins@outlook.com with the swimmer’s name, venue, class day/time, and details.

ii. We aim to acknowledge complaints within 48 hours.

iii. We aim to provide a substantive response within 72 hours (usually within business hours and excluding bank holidays).

 

Our responsibilities and liability

i. We will provide lessons with reasonable care and skill.

ii. Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot legally be excluded.

iii. We are not responsible for losses caused by events outside our reasonable control.

 

Data protection

i. We process personal data in line with UK GDPR and our Privacy Policy.

ii. We share information with venues or instructors only where reasonably necessary to deliver lessons safely and administer membership.

 

Changes to these terms

i. We may update these terms from time to time.

ii. If a change is material, we will give notice and make the updated version available.

iii. Continued attendance after the effective date means you accept the updated terms.

 

Governing law

i. These terms are governed by the laws of England and Wales.

ii. Disputes are subject to the courts of England and Wales.
